ASPC Mystery Box Terms & Conditions

General

The entity conducting the ASPC Mystery Box activities is UKISS Technology (“UKISS”).

By participating in the Anti Seed Phrase Club (“ASPC”) Mystery Box, you have agreed to be bound by these Terms and Conditions, any and all UKISS policies, as well as the rules and regulations relating to the relevant ASPC Mystery Box activity (as may be displayed on the UKISS site or UKISS Hub app and modified by UKISS from time to time at its sole discretion).

Only participants holding an Anti Seed Phrase Club non-fungible token (“ASPC NFT”) are entitled to participate in any ASPC Mystery Box activities (including but not limited to Hugware Instant Draw, Weekly Prizes, $15,000 Grand Draws, and $100,000 Ultimate Draw) and to receive, and/or redeem any prizes awarded from any ASPC Mystery Box activity.

The purchase of an ASPC Edition Hugware/ASPC NFT shall bind a Participant and/or Claimant to these ASPC Mystery Box rules.

No person under the age of sixteen (16) years shall be allowed to purchase an ASPC Edition Hugware and ASPC NFT or to claim any Prize in connection with a Winning ASPC NFT under these Rules.

UKISS employees are prohibited from participating in any ASPC Mystery Box activity.

Any and all rights of interpretation and explanation of these Terms & Conditions (and/or the rules and regulations of any ASPC Mystery Box Prizes activity) are exclusively reserved by UKISS.

UKISS reserves the right to vary these Terms & Conditions (including the terms relating to any individual ASPC Mystery Box activity) without notice, withdraw, or discontinue any ASPC Mystery Box activity at any time without any notice. In the event of inconsistency between (i) these Terms & Conditions, including the terms relating to any individual ASPC Mystery Box activity, and (ii) any marketing or promotional materials related to the ASPC Mystery Box, the Terms & Conditions (including the terms relating to any individual ASPC Mystery Box activity) shall prevail.

UKISS acknowledges and agrees that Android is not involved in ASPC Mystery Box in any manner whatsoever (whether as a sponsor, co-organiser, promoter or otherwise), and shall have no obligation to any person in connection with ASPC Mystery Box.

UKISS may make available translations of these ASPC Mystery Box Rules in other languages. In the event of any inconsistency between the translated versions and the English version, the English version shall be the authoritative version.

UKISS and Authorised Retailers shall not be liable for any loss, damage, costs, charges, fees or expenses of whatsoever nature and howsoever arising, whether direct, indirect, joint, several, actual, contingent or otherwise suffered, incurred or sustained by a Participant arising out of or in connection with the ASPC Mystery Box for any reason whatsoever, including but not limited to: the loss of an ASPC Edition Hugware and ASPC NFT; any payment made to the holder of an ASPC Edition Hugware and ASPC NFT where he alleges that such payment is made to the wrong person; the conduct of the Game in accordance with the Rules; reliance upon any omission, inaccurate information or statement concerning any matter whatsoever relating to the Participant to UKISS or any other matter whatsoever.

These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of Singapore. The courts of the Republic of Singapore shall have exclusive jurisdiction over all matters and disputes arising under or in relation to the Terms and Conditions.

All disputes not specifically covered by these Rules may be referred to UKISS, whose decision thereon shall be final and conclusive.

Intellectual Property

UKISS is the rightful owner or valid licensee of intellectual property rights of the “Anti Seed Phrase Club,” “Anti Seed Phrase Club Mystery Box,” “ASPC Mystery Box”, “ASPC Edition Hugware”, “ASPC Hugware” and “ASPC” (including but not limited to, patents, copyrights, trademarks, service marks, logos, trade names and know-how) in and to the Website (ukiss.io and aspcmysterybox.ukiss.io) and/or Mobile App (UKISS Hub) and all of its content (including but not limited to, software and programs, files, video, audio, music, pictures, images, photographs, graphics, animations, pictures, text and software).

You undertake not to reproduce, distribute, exploit, communicate, reverse engineer, decompile, disassemble, modify, translate or adapt any content, source code, design and any other intellectual property rights relating to the Website and/or Mobile App and its content, except in the following circumstances:

To the extent that such acts are required for the lawful and reasonable use of the Website and/or Mobile App; with the written express permission of UKISS; or to the extent permitted by any applicable law.

Use of Website

By participating in any ASPC Mystery Box activity, you agree and acknowledge that all personal data submitted may be collected, processed, stored, disclosed or otherwise used by UKISS for the purposes of conducting and administering the activity and is subject to the UKISS Privacy Policy found on ukiss.io.

The company shall not be responsible or liable to you in the event of any systems or communications errors, bugs, malware or viruses as a result of your use of the website and/or mobile app and its content which results in any damage to whatsoever to your hardware and/or software and/or data.

In order to use the website and/or mobile app, you may be required to download third party software. The company does not provide any warranty nor accept any liability in respect of any consequences of the download, installation, operation and/or use of such third party software.

The company does not warrant that the access to the website and/or mobile app and the content and services provided therein is legal in the jurisdiction that you access it from. It is your sole responsibility to ensure that you would be acting legally in accessing the website and/or mobile app and the content and services provided therein. You agree to bear full responsibility and to indemnify the company for any consequences of your unauthorised or illegal access.

Draws

Draws shall be held at such place, on such date, at such time and in such manner as may be decided by UKISS.

Each draw shall have a draw number, and this number is the identification number (ID) stated in the ASPC NFT.

Suppose during the course of any draw, any fault or failure shall occur in any associated equipment utilised for such draw. In that case, UKISS may, in its absolute discretion, declare such number or numbers as duly drawn or so much of the draw as at such time been completed as void and commence a new draw whether using the same equipment or otherwise. Upon the declaration of a draw as void as aforesaid, the same shall be deemed not to have taken place.

Prizes

UKISS has the sole and absolute discretion to update, modify or change (i) the prizes across all ASPC Mystery Box activities and (ii) the mechanics of any ASPC Mystery Box activity without prior notice and/or without liability to any party.

Any prize not claimed within ninety (90) days from the date of the relevant draw shall be forfeited.

Any prizes (of any value) won with any ASPC Mystery Box activity are not transferable, refundable, or exchangeable for cash or any items.

All Tether (USDT) prizes will be credited to the winner’s wallet within forty-eight (48) hours after redemption. UKISS will credit the prize amount only to the wallet address that secures the participant’s ASPC NFT, and not to any other wallet.

Physical prizes will be delivered to the address indicated on the details form, with the shipping fee borne by UKISS for such delivery. UKISS will not accede to requests for address changes once the delivery is confirmed and shall not be liable for any damage and/or loss concerning the delivery of such prize. The shipment duration depends on the courier service; users can track the shipment from the delivery information email. Unless expressly provided, UKISS makes no representation or warranty in relation to any prize (including the condition or suitability for any purpose) and shall not be liable in connection thereof.

Voucher prizes are non-transferable and will be emailed to the address provided by the winner in the details form. The voucher will be delivered within forty-eight (48) hours of redemption. In the event that the winner provided the wrong email address, UKISS will not resend the voucher to a different email address. 

UKISS will not be liable for any claims, costs, injuries, losses or damages of any kind whatsoever arising out of or in connection with the ASPC Mystery Box or with the acceptance or possession of any prize (including but not limited to claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, right of publicity or privacy, defamation, or portrayal in false light).

Participants who wish to submit a claim to UKISS in respect of any error in crediting Tether prizes may be required to provide a screenshot or such other evidence as may be required by UKISS. Failure to do so will result in the claim being rejected.

UKISS upholds the policy of paying out to the holder of a Winning ASPC NFT and is not obliged to ascertain whether the bearer of the Winning ASPC NFT is the rightful holder. UKISS’ decision on ownership of Winning ASPC NFTs shall be final and conclusive.

Payment of Prizes for any draw shall be made on such days and in such manner as shall be decided by UKISS.

The payment of any Prize won by an ASPC NFT holder shall constitute a complete discharge of UKISS’ liability in respect of that ASPC NFT.
